DISPUTE RESOLUTION

Our Approach
In business, disputes are inevitable. There is no magical pre-emptive solution to preventing each and every dispute from happening. The fact is that when a commercial dispute arises, businesses need the understanding and insight of professional legal advice. At Valenti Lawyers, we aim to act for our clients with as much ease as possible in an often tense situation. At Valenti Lawyers we aim to act for our clients to resolve the dispute before resorting to legal action. We endeavour to save our clients from the cost and delays of court proceedings and prefer to approach commercial disputes from this perspective. We provide our initial written advice as to our clients’ chances of recovery and the resolution of the dispute and our reasonable estimate (not quote) of the legal cost to achieve a resolution of the dispute in a reasonable time. At Valenti Lawyers we do not view commercial disputes as a “win at all costs” matter. It is our philosophy that it is in our clients’ best interests to shift perception away from the rigid notion of winning and losing and aim to resolve the dispute at hand.

Our Clients
Valenti Lawyers clients include Corporations, Small and Medium Enterprises, Lending Institutions and Individuals.

Our Role
Our role in Dispute Resolution includes resolving disputes by alternate means to litigation, via informal negotiation or mediation. This process involves a critical examination of the central issues, identifying the best means to resolve the dispute without litigation and enables a negotiated settlement. Significantly, if successful in this process, our approach enables clients to self-determine their disputes in the future. If court proceedings have commenced, Valenti Lawyers aim to look to other means of resolving the dispute without going to trial. This may be through mediation, pre-trial conferences or other forms of alternate dispute resolution.
